Below you will find some indicators showing that the worker is an employee, the work relationship will be a “contract of service”:
- an individual who works part-time, full-time or temporary under a contract of employment, whether oral or written, and has recognized rights and duties, is an employee. He or she are hired by the employer after an application and interview process results
- the payer chooses and controls the method and amount of pay
- the payer decides what jobs the employee (worker) will do
- the payer decides when and in what manner the job is to be done by the employee
- the worker receives training or direction from the payer on how to do the work
- the payer supplies most of the tools and equipment the worker needs, and is responsible for repair, maintenance, and insurance costs.
- the worker supplies the tools and equipment and the payer reimburses the worker for their use
- the payer provides the facilities and supplies the worker needs
- Integration needs to be considered by positively answering a question: are you performing a service and the result of the work is developing the employer’s business?
- the contract of service is your sole or primary source of income
